The following terms of use (“Terms") govern all use of the moreirasmagic.com.au and moreirasmagic.com websites (“Website”) and all content, services and products available at or through the Website.

The Terms also apply for all other Moreira’s Magic platforms, including its Social Media Accounts (@MoreirasMagic on Twitter, Facebook and Instagram), Email (info@moreirasmagic.com.au and questions@moreirasmagic.com.au), Newsletters (via Email and/or the Website) and Podcasts (via Apple Podcasts, Spotify, PodBean and the Website).

The Website is owned and operated by Moreira’s Magic Pty Ltd (ABN 73 647 253 290) (“Moreira’s Magic”). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on this Site by Moreira’s Magic (collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the website, you agree to become bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Moreira’s Magic, acceptance is expressly limited to these terms.

The website of Moreira’s Magic is copyrighted property. All Rights Reserved. Moreira’s Magic operates moreirasmagic.com.au and moreirasmagic.com.

This website, analysis, information, logos and all associated material, may not be reproduced, duplicated, copied, shared, sold or otherwise exploited for any purpose that is not expressly permitted by Moreira’s Magic.

Refund Policy:
We stand behind our products and your satisfaction with them is important to us We offer a 100% money-back guarantee.. If for any reason you are not satisfied within 24 hours of payment, simply send an email to info@moreirasmagic.com.au and we will refund your full purchase price and cancel your product subscription. After 24 hours, no refunds are accepted due to the nature of our time-sensitive product.

Predictions/Accuracy:
No guarantees or warranties of any kind are made regarding the projected playing status, statistics, commentary, or fantasy points for any player. The projections and commentary provided constitute a best guess prediction by Moreira’s Magic and are not guaranteed to any degree of accuracy. Moreira’s Magic shall not be held liable for financial losses, lost earnings, or any other damages due to actions made by the user based on the predictions on the website or other content produced by Moreira’s Magic.

By using this website, you also understand that its content may contain inaccuracies or typographical errors and you agree to hold Moreira’s Magic harmless from any claims, actions or demands resulting from your use of this website.

Access:
Moreira’s Magic takes every action to maintain the Website, hosting, maintenance and functioning of moreirasmagic.com.au. However, due to the nature of the internet and website hosting, can make no guarantees as to the functioning or accessibility of the Website. Digital products will not be refunded due to temporary website outages.

No Unauthorized Access:
You may not share or attempt to gain unauthorized access to our services. Access is for members only. Moreira’s Magic reserves the right, in its sole discretion, to terminate your access to the website at any time, without notice. Moreira’s Magic may, at their sole discretion, choose to issue full or partial refunds in the event of account termination.

Third Party Websites:
Moreira’s Magic utilises third party vendors to enhance user interaction as well as provide additional content to certain users. Moreira’s Magic does not run, administer or manage these sites and as such are not responsible for issues pertaining to their use, management, access or other technical issues such sites may experience. Any issues with access, content, accounts or use of such third-party sites must be directed towards that site’s administrator/support team. Moreira’s Magic is not responsible for any technical issues occurring from use of third-party sites and as such no refunds can be given due to issues with third party websites. In no way shall Moreira’s Magic be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to a user in connection with any such external third-party websites.

Player Photographs:
The player photographs have been sourced from a number of places.

All player photographs used on the Website (excluding those listed at the bottom of this document) are attributed to Wikipedia and are not public domain. No changes were made to the original images. Please respect the copyright protection. It may only be used according to the terms of the license.

All player photos from Wikipedia are licensed under the Creative Commons Attribution-Share Alike 4.0 International license.

Some player photos were taken by their AFL club and permission was provided to Moreira’s Magic for use. You are not free to share or adapt these photos for any reason without approval from the individual clubs. These players and their respective clubs are listed at the end of this document.

To better protect your privacy, we provide a notice explaining our online information practices and the choices you can make about the way your information is collected and used on our Services. Infringement Policy
Moreira’s Magic respects the intellectual property of others, and we ask our users to do the same. Our Services and materials incorporated by Moreira’s Magic therein are protected by copyrights, trademarks, or other proprietary rights. Some of the characters, logos or other images incorporated by Moreira’s Magic in our Services are also protected as registered or unregistered trademarks, trade names and/or service marks owned by Moreira’s Magic.

Affiliations:
Moreira’s Magic is not endorsed by or affiliated in any way with the Australian Football League, or the official AFL Fantasy and KFC SuperCoach websites. Moreira’s Magic is also not endorsed by or affiliated in any way with the National Basketball Association (NBA), Yahoo, ESPN, or any other provider of Fantasy NBA.

Payments
All payments are made via a trusted third-party payment platform (stripe.com). Payments are made under the third party’s terms and conditions and Moreira’s Magic is not responsible for any payment issues. We do not store any credit card, debit card or other similar details you provide to us outside of the Stripe system. Payments automatically convert to the user’s default settlement currency. International Users:
We value our international users. Moreira’s Magic is controlled, operated and administered within Australia. If you access the website from a location outside Australia, you are responsible for compliance with all applicable laws.

Moreira’s Magic AFL Season Guide:
The Moreira’s Magic AFL Season Guide is available for the preseason only. It will be regularly updated from when it launches, throughout the preseason, right up until Round 1. Once the AFL Home and Away Season begins, the information will not be updated and holders will no longer have access to any additional content produced throughout the 2023 season without becoming an In Season Member. All accounts may be deleted at any time once the season begins.

Moreira’s Magic AFL In Season Membership:
The Moreira’s Magic In Season membership begins at the commencement of the AFL Home and Away Season. Payment can be made outright or weekly. Weekly members can cancel at any stage by emailing info@moreirasmagic.com.au. All memberships will be automatically cancelled at the end of the AFL Home and Away Season.

If a member misses a payment, they will receive a reminder email and then lose access to their account until the payment is made. If your payment card is lost, cancelled or expired, you will need to update your details by emailing info@moreirasmagic.com.au.

Moreira’s Magic NBA Draft Guide
The Moreira’s Magic Draft Guide is available for the preseason only to help users with their NBA Fantasy drafts. It will be regularly updated throughout the preseason, right up until the commencement of the regular NBA season. Once the regular NBA Season begins, the information for that season will not be updated. All accounts may be deleted at any time once the season begins.

Magic Up
Moreira’s Magic has an arrangement with Magic Sports Entertainment Pty Ltd (ABN 96 654 830 565)(“Magic Sports”), a related party of Moreira’s Magic, to provide premium information, analysis and other services integrated into various Magic Sports platforms.

The service is called Magic Up.

You do not need Magic Up to play or win prizes in the various Magic Sports competitions, and Magic Up does not increase your chances of winning any prizes.

Payment for Magic Up is charged by Moreira’s Magic and not by Magic Sports, however Magic Sports may receive a commission from Moreira’s Magic in relation to entrants who Magic Up.

Magic Up services are not transferable across Magic Sports competitions and only relate to the competition it has been purchased for.

Entrants who Magic Up via a Magic Sports platform agree to become bound by the terms and conditions of this Agreement.

Podcasts:
We produce both free podcasts via public platforms and member-only podcasts via the Website. The Terms of Use apply to our podcasts. Podcasts may contain explicit language and listener discretion is advised.

Competitions:
Moreira’s Magic may run a competition for Season-Long Members of Moreira’s Magic, such as the highest ranked Moreira’s Magic Season-Long Member for the Season or the Highest Weekly Score. Entry is free and to be considered a Moreira’s Magic Season Long-Member, you must be both a 2023 Season Guide holder and an In Season member for all 24 rounds of the 2023 AFL Home and Away Season.

Winners must have a valid email address.

Prizes are to be confirmed. Any Prizes that may be won by an entrant under 18 years of age will be awarded to their parent / guardian.

Moreira’s Magic’s decision in respect of any prizes is final and no correspondence will be entered into. Moreira’s Magic reserves the right, in its sole discretion, to cancel or suspend any competition it runs.

All competitions run by Moreira’s Magic are free and are considered a game of skill, not change.

Member wellbeing
Fantasy sports is supposed to be communal, fun, and an escape from the burden of everyday life. However, fantasy sports can also cause angst, stress and disappointment at times. While we attempt to celebrate the fun component of fantasy sports in our content, there is no guarantee that you will not experience adverse impacts or emotions and you do so at your own risk.

Sponsors
Moreira’s Magic may promote third party content on the Website, Podcasts or Social Media channels that has been paid for by the third-party company. These companies may engage in activities which are not suitable for people under the age of 18 and members should read the third party’s terms and conditions.

Donations
Moreira’s Magic was established to bring joy through fantasy sports and Moreira’s Magic commits to using some of the proceeds from its services to donate to various charities. To date, over $100,000 have been donated as a result of the Moreira’s Magic services.

If a donation commitment is made by Moreira’s Magic, donations will be made within 12 months of receiving proceeds.

Donations may be made by a related party and/or director of Moreira’s Magic.

If a donation commitment is given, it is guaranteed that the donation will take place and proof of donation can be provided on request. If a commitment level is reached, the use of additional proceeds will be used at Moreira’s Magic’s discretion and Moreira’s Magic does not have to provide notification when the commitment level is reached.

If the commitment is a Starlight Wish, it is assumed that a Starlight Wish is worth AUD $6,500.

Miscellaneous
Moreira’s Magic reserves the right to change these Terms of Use at any time in its discretion and to notify users of any such changes solely by changing this Terms of Use. Your continued use of the website after the posting of any amended Terms of Use shall constitute your agreement to be bound by any such changes.

Moreira’s Magic may modify, suspend, discontinue or restrict the use of any portion of the website, including the availability of any portion of the content at any time, without notice or liability. Moreira’s Magic may deny access to any person or user at any time for any reason.
