Moreira’s Magic – Terms of Use

1. Acceptance of Terms
These Terms of Use govern all access to and use of moreirasmagic.com.au and moreirasmagic.com (the Website), together with all content, services and products made available through the Website or any other Moreira’s Magic platforms, including but not limited to:
• Social media accounts (including @MoreirasMagic on X, Facebook and Instagram)
• Email communications (including info@moreirasmagic.com.au and questions@moreirasmagic.com.au)
• Newsletters distributed via email or the Website
• Podcasts distributed via the Website or third‑party platforms such as Apple Podcasts and Spotify
The Website and related services are owned and operated by Moreira’s Magic Pty Ltd (ABN 73 647 253 290) (Moreira’s Magic, we, us, our).
By accessing or using any part of the Website or related services, you agree to be bound by these Terms of Use and any additional policies or notices published by Moreira’s Magic from time to time, including our Privacy Policy. If you do not agree, you must not access or use the Website or services.
2. General Use and Intellectual Property
All content on the Website and across Moreira’s Magic platforms, including analysis, data, commentary, logos, branding, text, graphics and other materials (Content), is protected by copyright and other intellectual property laws.
Unless expressly permitted by Moreira’s Magic, you must not:
• reproduce, copy, distribute or share any Content
• sell, license or commercially exploit any Content
• scrape, mine or harvest data from the Website
• create derivative works from any Content
• display or distribute Content on any other platform or network
All rights not expressly granted are reserved by Moreira’s Magic.
3. Refund Policy
We aim to be fair and transparent with our pricing.
If you are not satisfied within 24 hours of payment, you may request a full refund by emailing info@moreirasmagic.com.au. Your subscription will be cancelled and the purchase price refunded.
After 24 hours, refunds are generally not available due to the time-sensitive nature of our content.
4. Predictions, Analysis and Accuracy Disclaimer
All player projections, analysis, statistics, commentary and opinions published by Moreira’s Magic are provided for informational and entertainment purposes only.
No guarantees or warranties are made regarding:
• player selection or availability
• statistical performance
• fantasy scoring outcomes
• accuracy or completeness of any data or analysis
Content represents best‑estimate opinions at the time of publication and may contain errors or inaccuracies. You acknowledge that any decisions you make based on our Content are made at your own risk.
To the fullest extent permitted by law, Moreira’s Magic is not liable for any loss, damage or expense (including financial or consequential loss) arising from reliance on our Content.
5. Access and Availability
We take reasonable steps to maintain the operation and availability of the Website. However, we do not guarantee uninterrupted or error‑free access.
Temporary outages, maintenance periods or technical failures may occur and do not entitle users to refunds or compensation for digital products or services.
6. Accounts and Unauthorised Access
Access to member‑only services is personal and must not be shared.
You must not:
• share login credentials
• allow others to access your account
• attempt to gain unauthorised access to any part of the Website or services
Moreira’s Magic may suspend or terminate access at its discretion for any breach of these Terms. Refunds following termination may be issued at our discretion.
7. Third‑Party Services and Websites
Moreira’s Magic may integrate or link to third‑party platforms or services.
We do not control or operate these third‑party services and are not responsible for their content, availability, security or performance. Any issues relating to third‑party platforms must be directed to the relevant provider.
No refunds are available for issues arising from third‑party services.
8. Player Photographs
Player photographs used on the Website may be sourced from:
• Wikipedia under the Creative Commons Attribution‑ShareAlike 4.0 International licence
• AFL clubs that have granted permission for use
Wikipedia‑sourced images are not public domain and must be used in accordance with the applicable licence, including attribution requirements.
Club‑supplied images may not be reused, shared or adapted without permission from the relevant club.
9. Privacy
Your privacy is important to us. Our Privacy Policy explains how personal information is collected, used and stored. By using the Website or services, you agree to our Privacy Policy, which forms part of these Terms of Use.
10. Affiliations Disclaimer
Moreira’s Magic is not endorsed by, affiliated with or connected to:
• the Australian Football League (AFL)
• AFL Fantasy or KFC SuperCoach
11. Payments
Payments are processed via Stripe, a third‑party payment provider. Moreira’s Magic does not store your payment details.
All payments are subject to Stripe’s terms and conditions. Currency conversion occurs automatically based on the user’s settlement currency.
12. International Users
Moreira’s Magic is operated from Australia. Users accessing the Website from outside Australia are responsible for complying with all applicable local laws.
13. Memberships and Products
Pre‑Season Guides
Pre‑season products are updated during the AFL pre‑season only. Updates cease once the AFL Home and Away Season commences, unless otherwise stated.
In‑Season Memberships
In‑season memberships commence at the start of the AFL Home and Away Season and conclude at the end of that season.
• Payments may be upfront or recurring, where offered
• Recurring memberships may be cancelled by emailing info@moreirasmagic.com.au
• Access may be suspended if payments fail until resolved
Membership dates, inclusions and pricing may change from season to season.
14. Podcasts
We publish both free and member‑only podcasts. Podcasts may contain explicit language and listener discretion is advised. These Terms apply to all podcast content.
15. Competitions
Competitions may be run by Moreira’s Magic or by Magic Sports Online (ABN 54 675 250 487), a related entity.
• Competitions run by Magic Sports are governed by Magic Sports’ own terms
• Moreira’s Magic competitions are games of skill and free to enter
• Winners must have a valid email address
• Prizes are subject to availability and confirmation
• Prizes for entrants under 18 will be awarded to a parent or guardian
Moreira’s Magic may cancel or suspend competitions at its discretion. Decisions are final.
16. Member Wellbeing
Fantasy sports are intended to be fun, communal and an escape from everyday pressures. However, we recognise that fantasy sports can sometimes cause stress, frustration or emotional strain.
Your wellbeing matters to us. If participation in fantasy sports or use of our services is negatively impacting your mental health or personal circumstances, we encourage you to contact us and we will cancel your membership and provide a full refund.
You acknowledge that use of our services is otherwise at your own risk.
17. Sponsors and Advertising
We may publish paid or sponsored content. Some sponsor activities may not be suitable for users under 18. Users should review third‑party terms before engaging.
18. Donations
Moreira’s Magic was established to bring joy, connection and positivity through fantasy sports. We are proud to commit a portion of proceeds generated through our services to charitable causes.
Since inception, over $190,000 has been donated as a direct result of Moreira’s Magic activities.
Key principles of our donation approach include:
• Donations may be made to registered charities, foundations or community causes aligned with our values
• Donations may be made directly by Moreira’s Magic or by a related entity
• Donations will generally be made within 12 months of receiving the relevant proceeds
• Where a donation commitment is publicly stated, that commitment is guaranteed
• Proof of donation can be provided on request
In some cases, we may publicly state a target or commitment level. Once that level is reached, any additional proceeds may be allocated at Moreira’s Magic’s discretion and we are not required to provide notice when the target has been met.
Where donations relate to a Starlight Wish, the assumed value is:
• AUD 6,500 for donations attributed to the period 2018 to 2024
• AUD 7,500 for donations attributed from 2025 onwards
Donation structures, recipients and amounts may vary over time, but our commitment to giving back remains ongoing.
19. Limitation of Liability
To the fullest extent permitted by law, Moreira’s Magic is not liable for any loss or damage arising from use of the Website or services.
Nothing in these Terms limits rights that cannot be excluded under Australian Consumer Law. Where liability cannot be excluded, it is limited to resupplying the relevant goods or services.
20. Force Majeure
Moreira’s Magic is not liable for failure or delay caused by events beyond reasonable control, including natural disasters, pandemics, government actions, labour disputes, or telecommunications failures.
21. Changes to Terms
We may update these Terms of Use at any time. Continued use of the Website after changes are published constitutes acceptance of the updated Terms.
