General

These Terms of Use govern your access to and use of moreirasmagic.com.au and moreirasmagic.com (the Website), along with all content, services and products provided by Moreira’s Magic.

They also apply to other Moreira’s Magic platforms, including:

The Website is owned and operated by Moreira’s Magic Pty Ltd (ABN 73 647 253 290) (“Moreira’s Magic”, “we”, “us”, “our”).

By accessing or using the Website or any of our services, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Website.

Intellectual Property

All content on the Website, including analysis, statistics, text, graphics, logos and branding, is owned by or licensed to Moreira’s Magic.

You may use the content for personal, non-commercial purposes only. Unless we expressly permit it, you must not copy, reproduce, distribute, sell, share or otherwise exploit our content.

Refunds

We stand behind our products and your satisfaction with them is important to us.

If you’re not satisfied within 24 hours of payment, you may request a full refund by emailing info@moreirasmagic.com.au. Your subscription will be cancelled and your purchase refunded.

Because our products are time-sensitive, refunds after 24 hours are not usually available. That said, we understand that life happens and aim to be fair and reasonable wherever possible.

Predictions and Accuracy

All projections, commentary and analysis published by Moreira’s Magic are opinions only and are provided for entertainment and informational purposes.

Fantasy sports are unpredictable. We do not guarantee player availability, performance, statistics or fantasy scores, and content may occasionally contain errors or change as new information becomes available.

Any decisions you make based on our content are your own, and Moreira’s Magic is not responsible for outcomes or losses arising from those decisions.

Website Access and Availability

We take reasonable steps to keep the Website operating smoothly. However, temporary outages, maintenance or technical issues may occur.

Temporary interruptions do not entitle users to refunds or compensation for digital products or services.

Accounts and Fair Use

Access to member-only areas is for individual use only. Please do not share login details or attempt to access areas you are not authorised to use.

We reserve the right to suspend or terminate access where these Terms are breached. In some circumstances, refunds or partial refunds may be offered at our discretion.

Third-Party Services

We may use or link to third-party platforms to help deliver content or services.

We do not control these services and are not responsible for their availability, content or performance. Any issues relating to third-party services should be directed to the relevant provider.

Player Photographs

Player photographs used on the Website come from a range of sources, including:

  • Wikipedia, licensed under the Creative Commons Attribution-ShareAlike 4.0 licence
  • AFL clubs that have granted permission for use

Wikipedia images must be used in accordance with the licence terms, including attribution. Club-provided images must not be reused without permission from the relevant club.

Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use and protect your personal information and forms part of these Terms of Use.

Affiliations

Moreira’s Magic is not endorsed by or affiliated with the Australian Football League, AFL Fantasy, KFC SuperCoach, the National Basketball Association, Yahoo, ESPN or any official fantasy sports providers.

Payments

Payments are processed securely through Stripe. Moreira’s Magic does not store your credit or debit card details.

All payments are subject to Stripe’s terms and conditions, and currency conversion is handled automatically by the payment provider.

International Users

Moreira’s Magic is operated from Australia. If you access the Website from outside Australia, you are responsible for complying with all applicable local laws.

Products and Memberships

Season Guides are pre-season products and are updated until the start of the AFL Home and Away Season, unless stated otherwise.

In-Season Memberships run for the duration of the AFL Home and Away Season. Where recurring payments are offered, memberships can be cancelled at any time by emailing info@moreirasmagic.com.au.

Missed payments may result in temporary loss of access until resolved.

Podcasts

We publish both free and member-only podcasts. Some episodes may contain explicit language and listener discretion is advised.

Competitions

Moreira’s Magic may run free competitions or promotions. Some competitions may be run by Magic Sports Online (ABN 54 675 250 487), which operates under its own Terms and Conditions.

Unless stated otherwise:

  • Competitions are games of skill
  • Winners must have a valid email address
  • Prizes are subject to availability
  • Prizes won by entrants under 18 will be awarded to a parent or guardian

Our decisions are final and competitions may be amended, suspended or cancelled if required.

Member Wellbeing

Fantasy sports should be fun, social and enjoyable. We also recognise that it can sometimes cause stress, frustration or disappointment.

Your wellbeing is important to us. If fantasy sports are becoming too consuming or negatively affecting your mental health or personal circumstances, we encourage you to take a break or reach out.

You may cancel your membership at any time, and refunds or partial refunds may be offered where fantasy sports are impacting your wellbeing. Requests are handled with care, respect and confidentiality.

Sponsors and Advertising

We may feature sponsored or paid content across the Website, podcasts or social media channels. Some sponsor activities may not be suitable for people under 18, and users should review third-party terms before engaging.

Donations

Moreira’s Magic was created to bring joy through fantasy sports, and giving back is an important part of what we do.

To date, over $100,000 has been donated through Moreira’s Magic initiatives.

Donations:

  • Are made to charities or community causes aligned with our values
  • May be made by Moreira’s Magic or a related entity
  • Are generally made within 12 months of receiving proceeds
  • Are guaranteed where a public commitment is stated

Proof of donation can be provided on request. Once a stated donation target is reached, any additional proceeds may be allocated at our discretion.

Where donations relate to a Starlight Wish, we assume a value of:

  • AUD 6,500 for donations attributed to 2018–2024
  • AUD 7,500 for donations attributed from 2025 onwards

Liability

To the extent permitted by law, Moreira’s Magic is not liable for loss or damage arising from use of the Website or services.

Nothing in these Terms limits rights you may have under Australian Consumer Law. Where liability cannot be excluded, it is limited to resupplying the relevant goods or services.

Force Majeure

Moreira’s Magic is not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, pandemics, government actions or major technical outages.

Changes to These Terms

We may update these Terms of Use from time to time. Continued use of the Website after changes are posted means you accept the updated Terms.
